(1.) An application under Section 125 of Cr.P.C.
was moved on behalf of the applicants-revisionists for
grant of monthly maintenance allowance from Kanwal
Pal Singh (O.P. / respondent). The application under
Section 125 of Cr.P.C. was allowed in part. O.P. /
respondent was directed to pay a monthly maintenance
allowance of Rs. 750/- to his son Master Sukhdeep
Singh till he attains the age of majority. The
application moved on behalf of revisionist Smt.
Kanwaljeet Kaur was dismissed, vide impugned
judgment and order dated 15.09.2003. Aggrieved
against the said judgment and order, present criminal
revision was preferred.
(2.) O.P. / respondent was issued notice. The
same could not be served upon him in person. The
revisionist, therefore, took fresh steps for substituted
service upon him. The notice was, accordingly,
published in daily newspaper 'Amar Ujala', New Delhi
Edition, on 25.07.2007, yet none appeared for the O.P. /
(3.) The hearing of the application under Section
125 of Cr.P.C. also took place in the absence of O.P. /
respondent. In other words, the hearing of application
under Section 125 of Cr.P.C. was ex parte and,
accordingly, ex parte judgment was delivered on
15.09.2003. No written statement was filed on behalf
of O.P. / respondent.;
