JUDGEMENT

- (1.) The applicant Yusuf (in C-482 Petition No. 851 of 2008), by means of this application under Section 482 Cr.P.C., seeks to quash the summoning order dated 02.04.2008 passed by C.J.M, Haridwar as well as the proceedings of criminal case no. 1816 of 2008 captioned as State vs. Yusuf under Sections 3 & 14 of the Child Labour (Prohibition & Regulation) Act, 1986 (hereinafter referred to as 'the Act'), pending in the Court of Chief Judicial Magistrate, Haridwar.
(2.) Likewise, applicant Minu (in C-482 Petition No. 852 of 2008), by means of this application under Section 482 Cr.P.C., seeks to quash the summoning order dated 02.04.2008 passed by C.J.M, Haridwar as well as the proceedings of criminal case no. 1812 of 2008 captioned as State vs. Minu under Sections 3 & 14 of the Child Labour (Prohibition & Regulation) Act, 1986, pending in the Court of Chief Judicial Magistrate, Haridwar.
(3.) Assistant Labour Commissioner, Haridwar challaned applicants Yusuf and Minu in connection with offences punishable under Sections 3 /14 of the Act. The complainant alleged that Master Neeraj, aged about 8 years and Ms. Rakhi, aged 12 years were employed by Yusuf in a sugarcane grinder, which is used for extracting sugarcane juice in 'Yusuf ki Charkhi' situated at bus stand, Sultanpur, Haridwar.;
