JUDGEMENT

- (1.) Since in this case the appellants were not being represented by any counsel at the time of final hearing, this Court vide order dated 21.02.2013 appointed Mr. Raveendra Singh Bisht, Advocate as Amicus Curiae for the appellants who has assisted the Court. He was given paper book and time to prepare the matter.
(2.) Heard Mr. Raveendra Singh Bisht, Amicus Curiae for the appellants and Mr. Suhail Siddiqui, A.G.A. with Mrs. Meena Bohara, Brief Holder for the State.
(3.) The present appeal arises out of the judgment and order dated 23.03.2004 passed by the Sessions Judge, Bageshwar in Sessions Trial No.4/2003, whereby both the appellants i.e. Kunwar Ram and Nand Ram were convicted under Section 376(2)(g) of the I.P.C. read with Section 511 I.P.C. and sentenced to undergo rigorous imprisonment for four years and a fine of Rs.1,000/- each. In default of payment of fine, both the appellants have to further undergo rigorous imprisonment for three months. The appellants /accused were also convicted under Section 506 I.P.C. and sentenced to undergo rigorous imprisonment of one year.;
