(2.) This revision is directed against the order dated
12.07.2013 passed by Civil Judge (Sr. Div.), Dehradun in
O.S. No.524 of 2007, whereby the said court has rejected
the counter claim of the defendants under Order VII
Rule 11 of Code of Civil Procedure, 1908.
(3.) Learned counsel for the respondents pointed out
that the revisionists are trying to delay in proceeding of
the suit for one reason or other. In this connection, it is
pointed out that in suit for possession and injunction
filed by plaintiff (purchaser of the house) against the
defendants (sellers), filed in year 2007, a counter claim
was made by the defendants in the year 2008 without
making payment of court fee. Thereafter, by moving an
application, they sought that they be declared pauper,
which was rejected.;
