JUDGEMENT

- (1.) URGENCY application no. 786 of 2013 is allowed.
(2.) HEARD . By means of this writ petition moved under Article 226 of Constitution of India, the petitioner has sought quashing of the order dated 08.01.2013 passed by respondent no. 1 in complaint no. 7353 of 2013 under section 19 (3) of Right to Information Act, 2005.
(3.) LEARNED counsel for the petitioner submitted that vide order dated 12.06.2012, respondent no. 1 directed in respect of Dr. N.K. Pandey, Dy. Nagar Adhikari/ Public Information Officer that recovery of Rs. 5,000/ be made from him as penalty. It is further pleaded that present petitioner is Mukhya Nagar Adhikari of Nagar Nigam/ Ist Appellate Authority, Dehradun. It is contended that since Dr. N.K. Pandey filed a writ petition no. 2484 (M/S) of 2012, and obtained stay order on 07.12.2012 as such there was no occasion on the part of the present petitioner to comply order dated 12.06.2012 passed by respondent no. 1. On this ground it is argued that the impugned order directing the authorities to take disciplinary action against the present petitioner for non compliance of order dated 12.06.2012, of the respondent no. 1 is erroneous in law.;
