JUDGEMENT

- (1.) The applicants, by way of present petition under Section 482 Cr.P.C., seek to set aside the order dated 15.04.2008, passed in criminal complaint no. 2090 of 2007 Smt. Neera Chaudhary vs. Avnesh Kaushik and others, under Sections 452, 504 and 506 IPC, passed by learned ACJM, Haridwar .
(2.) On the basis of a complaint filed by respondent Smt. Neera Chaudhari, accused persons/applicants were summoned to face the trial for the offences punishable under Section 452, 504 and 506 IPC, in connection with the incident which took place on 04.06.2007 at 7:00 a.m.
(3.) Learned counsel for the applicants submitted that an application moved by the husband of respondent earlier regarding a dispute which arose over the same property was rejected by learned CJM, Haridwar on 11.04.2005. Learned counsel for the respondent, on the other hand, submitted that the summoning order dated 15.04.2008 was in relation to a fresh cause of action, which arose on 04.06.2007.;
