(1.) Heard learned Counsel for the revisionist and learned AGA for the State. Also perused the papers on record.
(2.) It appears that accused revisionist Harish Chandra Kapri was tried was tried for the offence of Section 326 IPC in State Case No. 6/2004. On conclusion of trial, learned Special Judicial Magistrate, Pithoragarh vide his judgment and order dated 5.3.2005 found him guilty for the said offence and sentenced him to undergo two years' rigorous imprisonment along with fine of rupees two thousand. In default of payment of fine, six months' imprisonment was awarded to the accused revisionist.
(3.) As per the prosecution version, accused revisionist assaulted Smt. Sumitra by a big service spoon (Kalchhi). He gave the blow of Kalchhi on her face in which her four teeth got broken. There was permanent privation of these teeth from her mouth. FIR was lodged. Investigation resulted in the submission of chargesheet.;
