(1.) These are the cross-appeals challenging the same judgment and order of the trial court dated 13.6.2001 rendered in S.T. No.97 of 1994, titled as State Vs. Raj Kumar Kakkar, hence are being adjudicated by this single judgment.
(2.) At the outset, it is pertinent to mention that the government appeal no.69 of 2005, being barred by limitation, was preferred along with the delay condonation application.
(3.) Though the delay has been condoned but the same is yet awaiting admission. On due consideration, leave to appeal is granted by allowing the application made therefor. Appeal is thus, hereby admitted for hearing.;
