(1.) Having heard learned counsel for the parties, it transpires that the petitioner and private respondent entered into a partnership to run a Hair & Beauty Saloon at Rajpur Road, Dehradun (Shop No.20-21). In the course of settling business, they were subjected to several money transactions including issuance of cheques, which later became the bone of contention between the two. Otherwise also, the dispute erupted between the partners on account of profit distribution. Petitioner no.2 Amit Sharma lodged an FIR bearing crime no.181/2004 on 16.7.2004 against the petitioner for the offences under section 420/406 IPC wherein the investigation resulted into the submission of chargesheet against the petitioner and one more person.
(2.) Thereafter, learned Magistrate on 1.10.2007 leveled the charge accordingly, whereagainst a revision was filed in the court of Sessions, but the same failed. 2
(3.) Thereafter, petitioner approached this Court by way of C482 petition no.398/2008 but the same was withdrawn by him on 25.6.2008, with liberty to avail of alternative remedies.;
