JUDGEMENT

- (1.) By this writ petition, the petitioner has challenged two orders dated 31.03.2005 and 29.08.2005 respectively. The first mentioned order was passed by respondent No. 3 by which the petitioner was removed from services while second mentioned order was passed by respondent No. 2 being the Appellate Authority.
(2.) The petitioner was chargesheeted in course of his discharging duty amongst others for temporary defalcation of the Government fund amounting to Rs. 3,000.00 and odd. The Enquiry Officer was appointed at the instance of the petitioner and he found him guilty.
(3.) The Disciplinary Authority accepted the report of the Enquiry Officer and imposed the punishment of removal of services. The petitioner preferred an appeal against the order of removal but unsuccessfully as the Departmental Appellate Authority dismissed the appeal by passing second mentioned order.;
