(1.) Heard learned Counsel for the parties and
perused the papers on record.
(2.) Challenge in this petition is made to the order
of cognizance dated 14.5.2007, passed by the learned
Additional Chief Judicial Magistrate I, Dehradun in
Criminal Complaint Case No. 2690/2011, Smt. Seema
Mehta v. Gajesh Dutt Mehta & Others, whereby the
accused applicants have been summoned to stand trial for
the offence under Section 406 IPC.
(3.) Other accused applicants are father-in-law and
mother-in-law of Ms. Seema Mehta. It transpires that Ms.
Seema was wedded on 13.7.2001 with Gajesh Dutt Mehta
as per Hindu rituals. Within one year of the marriage, she
was constrained to leave her matrimonial house due to
insatiable conduct faced by her at the hands of the
accused applicants. She felt daunted and having been
expelled from the matrimonial house, she came to reside
at her parent's house on 13.5.2002.;
