JUDGEMENT

- (1.) By means of this writ petition moved under Article 226/227 of Constitution of India, the petitioner has sought quashing of the order dated 23.05.2012, passed by learned Special Judge Anti Corruption/Vigilance Dehradun, in Special Sessions Trial No. 8 of 2011, whereby said court has decided to frame charge against the accused including the petitioner in respect of offences punishable under section 120B and 409 of I. P. C. and under section 13(1)(d) read with section 13(2) of Prevention of Corruption Act, 1988.
(2.) Heard learned counsel for the parties and perused the papers on record.
(3.) Petitioner was Chairman of Uttarakhand Jal Vidyut Nigam, who was appointed after his retirement as Special Advisor with the Government of Uttarakhand in the year 2006 to advise the government in the matters relating to the department of Power and Energy. The allegations against the petitioner is that he conspired with co-accused Sukhmal Chand Jain, Chairman of M/s Shring Construction Company Ltd. , and caused wrongful loss to the public exchequer to the tune of over Rs. 25 crore.;
