JUDGEMENT

Sudhanshu Dhulia, J. - (1.) HEARD Mr. Tapan Singh, Advocate for the applicant and Mr. Manoj Bisht, Advocate holding brief of Mr. Ajay Veer Pundir, Advocate for the respondent.
(2.) RESPONDENT No. 6 (applicant in the present contempt petition had sought certain information from Additional Director, Education Department, Garhwal Mandal, Pauri and it had directed the Block Education Officer/Information Officer to receive information regarding the school, namely, Rashtriya Inter College Sitapur, district Haridwar and give it to respondent No. 6. The said school in turn refused to give the information on the ground that it is not a public authority under the Right to Information Act and hence is not bound to give the information. Since the pressure was being made on the Principal of said school to furnish the information to respondent No. 6, he has filed a writ petition being Writ Petition No. 773 (MS) of 2011. A learned Single Judge of this Court though stayed the orders dated 17.3.2011 and 19.04.2011 of the authorities under the Right to Information Act on 28.4.2011, yet directed the petitioner to furnish information to respondent No. 6 within a period of four weeks. Presently the applicant (respondent No. 6 in Writ Petition No. 773 (MS) of 2011) is before this Court and stated that the respondent (petitioner in Writ Petition (M/S) No. 773 of 2011) has not complied with orders passed by this Court on 28.4.2011. The respondent in the present contempt petition who is being represented by Mr. Manoj Bisht, Advocate stated that the information, as sought has been given to the applicant as well as to the authorities under the Right to Information Act.
(3.) THIS being the factual position whether the information has been given to the applicant is sufficient or not is not to be seen in the present contempt petition. The applicant is free to submit it before the learned Single Judge of this Court in Writ Petition No. 773 (MS) of 2011, as to the insufficiency of the information given to him and that the order has not been complied with in its true letter and spirit.;
