JUDGEMENT

- (1.) In this writ petition, the petitioner wants writ of mandamus to be issued directing the respondent No. 2 to appoint the petitioner to the post of Shiksha Mitra in Primary School, Sartela, Block Okhalkanda, District Nainital.
(2.) In the body of the writ petition it is said that the appointment of respondent No. 3 is not lawful as he is not resident of the village Okalkanda. According to the petitioner, he has been teaching since 13.07.2005 in Primary School Sartela, Block Okhalkanda. In the meantime, an advertisement was issued for filling up the post of Shiksha Mitra. The petitioner submitted the application in response to the said advertisement, but nothing has been said in the petition what has happened pursuant to his application.
(3.) In the counter affidavit of respondent Nos. 1 and 2 it is stated that the petitioner along with respondent No. 3 participated in the selection process that was held pursuant to the said advertisement. Upon comparative assessment of the qualification, respondent No. 3 was found to be superior to the petitioner, as such he has been appointed.;
