JUDGEMENT

- (1.) Heard.
(2.) By means of this petition, moved under Section 482 of Cr. P. C. , the petitioner has challenged order dated 21.01.2012, passed by the trial court (Additional Sessions Judge/3 rd Fast Track Court), Rudrapur, District Udham Singh Nagar, in Sessions Trial No. 262 of 2011, whereby said court while 2 acquitting the accused from the charge, has further directed to issue notice against the petitioner Pradeep Singh (PW-2) as to why, the proceedings be not drawn against him under Section 366 of Cr. P. C.
(3.) Attention of this Court is drawn by the petitioner to the copy of the compromise entered between the parties to matrimony (Satnam Chugh and his wife Preeti, sister of the complainant/present petitioner), on 24.11.2011, and it is argued that it is abuse of process of law on the part of the trial court to proceed against the witness under Section 344 of Cr. P. C. , in a matter, where the parties to matrimony have already entered into the compromise.;
