JUDGEMENT

- (1.) By means of this writ petition moved under Article 226/227 of Constitution of India, the petitioner has sought quashing of the order dated 05.05.2012, passed by Special Judge Anti Corruption/V0igilance/III Fast Track Court, Dehradun, in Special Sessions Trial No. 38 of 2011, whereby said court has decided to frame the charge against the petitioner in respect of offences punishable under section 120B and 409 of I. P. C. read with section 13(1)(d) read with section 13(2) of Prevention of Corruption Act, 1988.
(2.) Heard learned counsel for the parties and perused the papers on record.
(3.) Petitioner was appointed Honorary Special Advisor by the State of Uttarakhand in the year 2006 to advise it in matters relating to the department of Power and Energy. The allegations against him are that he favored a particular firm i. e. M/s Kayviat International Projects Consultants Pvt Ltd. in awarding contracts relating to Hydro Power Project. It appears that said firm was lessee of the petitioner's daughter in a house in Faridabad.;
