JUDGEMENT

- (1.) This criminal revision is directed against the judgment and order dated 16.12.2004, passed by the Special Judicial Magistrate, Haridwar in Criminal Complaint Case No. 364/2004, Inder Pal v. State of Uttaranchal & Others, whereby the accused respondents, namely, Chandra, Puran and Arvind have been acquitted from the charges of offences punishable under Section 323, 504, 506 IPC.
(2.) None has turned up on behalf of the revisionist even in the second revised call. Hence, hearing has been accorded to Smt. Mamta Bisht, AGA, for the State and Mr. Mohd. Umar, Advocate, holding brief of Mr. Navneet Kaushik, Advocate, for the accused respondents. Also perused the lower court record and the grounds of revision.
(3.) A perusal of the impugned judgment and order reveals that only two fact witnesses were examined before the court below, who were acquainted with the accused persons. These witnesses did not name the accused persons in evidence before the trial court. It was enough to acquit the accused respondents.;
