(1.) HEARD Mr. Kurban Ali, Advocate for the petitioner and Mr. H.M. Raturi, Standing Counsel for the State of Uttarakhand.
(2.) THE petitioner has challenged the action of administrative authorities, which are removing the hoardings placed by the petitioner. The case of the petitioner is that these hoardings have been placed by the petitioner under authorization from the local body i.e. "Nagar Palika", Haldwani (now Municipal Corporation, Haldwani). The petitioner has moved a representation before the District Magistrate, Nainital on 24.12.2011, which is still pending. Mr. H.M. Raturi, Standing Counsel for the State of Uttarakhand has fairly submitted that the writ petition of the petitioner may be decided with a suitable direction.
(3.) AS such, with the consent of the parties, this writ petition is disposed of at the admission stage with a direction to the District Magistrate, Nainital to decide the pending representation of the petitioner within four weeks from today. In case the concerned authority may feel that the hoardings are being put in violation of any law, it must take appropriate action in accordance with law but only after hearing the petitioner while passing such orders assigning reasons thereof. Till decision is taken on such representation, the hoardings shall not be removed. It is further made clear that the petitioner shall cooperate in the matter with the authorities.;
