JUDGEMENT

- (1.) Heard learned Counsel for the parties and also perused the papers on record.
(2.) Since the petitioners in both the above captioned petitions have challenged the same chargesheet pertaining to Crime No. 184/2011, PS Bhagwanpur, order of cognizance dated 1.9.2012, passed by the Judicial Magistrate, Roorkee, District Haridwar, and further consequential proceedings of Criminal Case No. 2956/2012, State v. Jagdish Prasad & Others, under Section 420, 409, 120B IPC, hence both these petitions are being decided by this common judgment and order.
(3.) Petition no. 1061/2012 has been filed by Mr. Biram Singh, while another Petition No. 1102/2012 has been filed by Smt. Rajbala Saini, Rati Ram, Ram Singh and Sulekh Chand. Vide the impugned chargesheet, besides the petitioners, two other persons, namely, Jagdish Prasad Saini and Roshan Lal Arya have also been chargesheeted. The former i. e. Jagdish Prasad Saini has reportedly died, while the name of latter Roshan Lal Arya has been added subsequently. For brevity, hereinafter the facts and papers pertaining to Petition No. 1061/2012 shall be referred to. ;
