- (1.) Having heard learned counsel for the parties, it appears that Ms. Deepa was wedded with Vikas Garg on 17.11.2010. Her father spent more than Rs. 4,00,000/- in solemnization of marriage including several offerings of dowry. Ms. Deepa, soon after marriage, faced tyrannical and tormented attitude at the hands of family members of her in-laws' house. They were further demanding Rs. 50,000/- and a motorcycle. Bridal side tried to sway them but all persuasions went in vain. Ultimately, as per allegations, she was expelled from her matrimonial house on 01.08.2011. When her father realised that nothing will settle the differences and there is no hope of compromise to resume matrimonial life, then he moved an application for lodging a report on 30.10.2011 and the same could be lodged at police station Kashipur on 17.11.2011 against husband and all the petitioners viz. Amit Garg, Surendra Garg, Poonam and Pooja, who are elder brother-in-law, father-in-law, mother-in-law and sister-in-law of Deepa respectively.
(2.) All the petitioners got arrest stay by this Court on 22.11.2011 in WPCRL No. 1016 of 2011. Investigation culminated into submission of chargesheet against all the petitioners and husband Vikas Garg for the offence under Section 498-A, 323 IPC read with Section of the Dowry Prohibition Act. Learned Magistrate took cognizance in the matter on 29.03.2012, so all the applicants have come up before this Court by way of filing this petition under Section 482 Cr.P.C. evoking the powers of this Court for quashing the chargesheet.
(3.) It has been apprised by learned counsel for the petitioners that Vikas Garg (husband) has not filed any petition and he has surrendered in the court below.;
