JUDGEMENT

- (1.) Having heard the learned counsel for the revisionist, it is apparent that respondent no.2 Ram Asrey is the father whereas, revisionist Govind is his real son. Respondent no.2 moved an application u/s 125 Cr.P.C., seeking maintenance to the tune of Rs.5,000/- per month from his son, as also Rs.40,000/- to get the medical treatment of the eyes of his wife Smt. Raghurai. It was averred that he is an old man aged about 70 years and also a heart patient. He also stated that because of lack of funds, he could not get the medical treatment of his wife, as a result of which she became blind. It was further averred that his son Govind, aged about 45 years, used to abuse and assault him and also extends torture in sundry ways. Lastly, it was stated that revisionist earns about Rs.20,000/- per month from doing a canteen business.
(2.) Judgment of the trial court makes it abundantly clear that the defendant appeared but did not file any written statement or objections before the court, so the learned Family Judge, Dehradun heard his oral submissions and also perused the evidence adduced by his father Ram Asre.
(3.) Learned Family Judge passed the impugned order, granting maintenance at the rate of Rs.3,000/- per month as well as Rs.15,000/- for the operation of the eyes of Smt. Raghurai. This judgment has been assailed by way of the instant revision.;
