JUDGEMENT

- (1.) Heard.
(2.) By means of this petition moved under section 482 of Cr. P. C. , the petitioner has sought quashing of the proceedings of Criminal Case No. 1446 of 2011, (old no. 488 of 2009) State vs. Bhagat and others, relating to offences punishable under section 420, 467, 468, 471 and 474 of I. P. C. , pending in the court of Civil Judge (Senior Division)/Additional Chief Judicial Magistrate, Roorkee.
(3.) Learned counsel for the petitioner submitted that petitioner was a Supply Inspector (a public servant), and he could not be prosecuted in respect of offence committed by him in discharge of his public duties without there being sanction granted by the State Government. Attention of this Court is drawn to section 197 of Cr. P. C. , and it is pleaded that the trial against the present petitioner is liable to be quashed.;
