- (1.) None has turned up either on behalf the revisionist or the accused respondents. Hence, this Court extended hearing to Mr. Sohail Siddiqui, AGA, for the State. Also perused the papers available on record.
(2.) This revision has been filed against the judgment and order of acquittal dated 3.9.2004, passed by the learned Additional Sessions/FTC I, Dehradun in Sessions Trial No. 272/2000, State v. Ramesh & 4 Others, whereby all the accused respondents, namely, Ramesh, Rajesh, Shivcharan, Smt. Rajjo Devi and Smt. Sheetal Devi have been acquitted from the charge of offences levelled against them under Section 363, 366, 376 IPC.
(3.) It was alleged that Km. Arti was enticed away by the accused respondents in order to marry her with one of the accused persons, namely, Shivcharan. Having perused the impugned judgment and order, it reflects that Km. Arti herself has disclosed before the trial court that she accompanied Shivcharan out of her own sweet volition. None had enticed her away. She has also stated that her parents wanted to marry her elsewhere against her wishes. At that time, she was at the verge of completing 18 years of age. 2 These were the major grounds for recording the finding of acquittal by the learned trial court.;
