LAWS(UTN)-2012-10-102
HIGH COURT OF UTTARAKHAND
Decided on October 19,2012

Abdul Lateef Appellant
VERSUS
STATE OF UTTARAKHAND Respondents

JUDGEMENT

- (1.) At the outset, it is pertinent to mention that none has turned up on behalf of the revisionist even in the second revised call, so this Court rendered hearing to learned State counsel.
(2.) Having heard learned counsel for the State, it transpires that this revision was preferred against the concurrent judgments and orders dated 22.08.2005 and 01.02.2007 passed by Chief Judicial Magistrate, Haridwar and Sessions Judge, Haridwar respectively whereby revisionist was convicted under Section 468 IPC and sentenced to undergo 4 years rigorous imprisonment with a fine of Rs. 1,000/-; he was also convicted under Section 471 & 417 IPC and sentenced to undergo 1 year and six months rigorous imprisonment respectively. All the terms of sentences had been directed to run concurrently.
(3.) Looking into the judgments impugned, it appears that offence wherefor accused revisionist Abdul Lateef was chargesheeted has been proved by PW1 Jaswant Singh, Principal, St. Thomas School Junior High School, PW2 Constable Satyapal Singh and PW 3 SSI Suresh Singh Tomar.;
