JUDGEMENT

- (1.) Heard Mr. Anirudha Joshi, the learned counsel holding the brief of Mr. Sharad Sharma, the learned senior counsel for the petitioner and Mr. Vikas Pandey, the learned counsel for the respondents.
(2.) The petitioner is a Constable in the Central Industrial Security Force and, in the year 2005 was deputed to work at the barrier erected on the road. Some complaints were received by the department that illegal extortion of money was being done by the Constables at the barrier from the truck drivers and, accordingly, a raid was conducted in which a sum of Rs.1050 was found wrapped in a polythene bag inside the tiffin box of the petitioner. According to the raiding party, the petitioner admitted his guilt and asked for forgiveness and he was asked to sign on the currency notes which was recovered. Subsequently, he was chargesheeted and, based on the reply, the enquiry proceedings were conducted and the petitioner was placed under suspension. The enquiry officer conducted the enquiry and gave full opportunity to the petitioner to defend himself and, upon the completion of the enquiry, the enquiry officer submitted his report holding that the charge levelled against the petitioner stood proved. Based on the findings given by the enquiry officer, a show cause notice was issued to the petitioner. Thereafter, the disciplinary authority passed the order of termination.
(3.) The petitioner, being aggrieved, filed an appeal which was rejected. Consequently, the present writ petition.;
