Prafulla C. Pant, J. - (1.) MR . Abhishek Verma, Advocate, present for the applicant. Mr. B.S. Parihar, Brief Holder, present for the State.
(2.) APPLICANT - Dharmveer who is in jail in connection with FIR no. 548 of 2011, relating to offences punishable under section 302, 201, 120B, 364, read with section 34 IPC, and one punishable under section 25 Arms Act, Police Station Kashipur, District Udham Singh Nagar, has sought his release on bail. Heard learned counsel for the parties.
(3.) IT is a case of circumstantial evidence. Co -accused Baldev Singh Danu and Purshottam Chauhan @ Mangal have already been directed to be released on bail. It is argued that merely on the statement of the co -accused the applicant cannot be held guilty.;
