JUDGEMENT

- (1.) Heard learned counsel for the parties and perused the record.
(2.) This petition has been filed seeking transfer of Original Suit No. 256 of 2011 titled as Rajendra Singh vs. Smt. Archana , from the Court of Judge Family Court, Dehradun to District Pithoragarh/Munsyari.
(3.) Submission of the learned counsel for the applicant is that the applicant is serving as Assistant Teacher in Inter College, Munsyari, District Pithoragarh. Marriage of the applicant was solemnized with the opposite party on 18.04.2008. They lived together for a short period. The applicant was desirous to stay with the opposite party and still the applicant intend to live with her husband, however the opposite party seems to be not willing to live with the applicant, therefore the opposite party filed divorce petition no. 256 of 2011 under Section 13 of the Hindu Marriage Act, 1955 before the Principal Judge, Family Court, Dehradun. Submission of the learned counsel for the applicant is that applicant is alone residing/serving at Munsyari and there is no male 2 member in her family who may accompany her to Dehradun and she is unable to travel alone and stay at Dehrdun for contesting the said case. He contended that the applicant is 28 years young lady, her father had already expired and her mother is only old lady in her family. He submitted that it is not only inconvenient to the applicant to go Dehradun, but it is also unsafe to her to travel alone. He further contended that, in case, if the applicant reaches Dehradun, the opposite party may harm her.;
