(1.) Both the above titled petitions are being disposed of by this common order, as the dispute, in both the petitions, is between same parties and of identical nature. At the outset, it is pertinent to mention here that none has turned up on behalf of respondent despite sufficient service, so this Court rendered hearing to learned counsel for the applicant.
(2.) Having heard learned counsel for the applicant and on going through the material available on record, it appears that in each petition, the dispute is only with regard to Rs. 25,000/- which was due upon applicant to be paid to Manoj Mehra respondent, so respondent instituted two complaints under Section 138 of the Negotiable Instruments Act in the court below wherein the learned Magistrate passed the impugned cognizance orders dated 31.05.2012.
(3.) Learned counsel for the applicant is ready to submit the Bank Drafts, each amounting to Rs. 25,000/-, which he has virtually shown to this Court.;
