JUDGEMENT

(1.) The petitioner is the holder of Indian passport bearing No.Q.394824 issued on 9.9.1993 by the Passport Officer, Kozhikode. In the said passport, the petitioner's name is shown as Razak. His date of birth is shown as 1971 without the date and month being specified. Relying on Ext.P1 extract of the school admission register and Ext.P2 identity card issued by the Election Commission of India, the petitioner states that his name is Abdul Razak and that his date of birth is 14.12.1975. The petitioner submits that though he approached the respondent to correct his name and date of birth in the passport, the application was not entertained. In this writ petition, the petitioner seeks a direction to the respondent to correct his name and date of birth in the passport.

(2.) Ext.P3 passport was valid only upto 8.9.2003. Therefore, the petitioner will necessarily have to apply for a fresh passport. At that stage, it will be open to him to convince the authorities that the description of his name as Razak and also the date of birth in the original of the passport issued to him by the Regional Passport Officer, Kozhikode on 9.9.1993 is erroneous. I accordingly dispose of this writ petition with a direction that in the event of the petitioner applying for a fresh passport accompanied by the original of Ext.P3 passport and documents proving the petitioner's name, identity and date of birth, the Passport Officer concerned shall consider the same and take an appropriate decision in the matter, after due enquiry in accordance with law.
