JUDGEMENT

G.S.Sistani, J. - (1.) Cm No.33220/2017 (exemption) Exemption allowed, subject to all just exceptions. The application stands disposed of. W.P.(C) 8075/2017 With the consent of the parties, the present writ petition is set down for final hearing and disposal.
(2.) This is a petition under Article 226 of the Constitution of India filed by the petitioner seeking a declaration that the acquisition proceedings with respect to the land comprised in Khasra No.515/150 situated in the revenue estate of village Dallupura, Delhi (hereinafter referred to as 'the subject land') is deemed to have lapsed in view of Section 24 (2) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (hereinafter referred to as '2013 Act'), as although the physical possession has been taken but the compensation with respect to subject land has not been paid to the petitioner.
(3.) Counsel for the petitioner submits that in this case, the subject land was purchased by Late Shri Mamraj (who was the grandfather of the petitioner) from Shri Khillu by way of a Power of Attorney. The petitioner has become the owner of the subject land by virtue of being one of the legal heirs of Late Shri Mamraj by way of a Special Power of Attorney.;
