JUDGEMENT

AGGARWAL, J. - (1.)DHARAM Pal, the appellant herein, was tried in the court of shri S.C. Jain, Additional Sessions Judge, on the charge of murdering Kamla. The accused was found guilty and sentenced to imprisonment for life. Against his conviction and sentence the accused has come in appeal.
(2.)THE case for prosecution as unfolded by Rakesh Kumar in the first report is as follows;
Ram Nath (PW 3) with his wife Raj Rani (PW 1) and the children including Vinod Kumar (PW 2). Rakesh Kumar (PW 7) and the deceased Kamla resided at Asha Park. The accused Dharan Pal is a cousin of PW 1. Dharam Pal had dairy business in Asha Park, about 8 plots away from the house of Ram Nath, PW.

(3.)ON 23rd March, 1979 at about 1.30 p.m. Rakesh, Vinod and Kamla were in house. Their parents had gone out Vinod was sleeping in the room. Kamla was cooking food on a stove in the verandah outside the kitchen. Dharam Pal came from outside with a bucket containing kerosene oil and he threw the kerosene oil in Kamla and ran away. The clothes of Kamla caught fire and she raise hue and cry. Rakesh and Vinod extinguished the fire and in doing so the also burnt their hands.
