(1.)On September 2, 1982 an Additional Sessions Judge, Delhi, convicted the appellant Raj Kumar in respect of commission on September 19, 1980 of an offence of murder of his wife Smt. Suresh alias Anaro punishable under section 302 Indian Penal Code and sentenced him to undergo imprisonment for life and also to pay fine of Rs. 500/- in default of payment of which to undergo rigorous imprisonment for three months. The present appeal is against the aforesaid conviction and sentence.
(2.)Smt. Suresh alias Anaro was daughter of Lal Singh (P. W. 1). Said Lal Singh a medical practitioner practicing in Ayurvedic and Unani system. He is residing at A/68. Patel Park, Bahadur Garh, District Rohtak (Haryana).
(3.)Smt. Suresh deceased was married to the appellant about six years prior to the occurrence. She gave birth to a daughter about 1-1/2 years before the occurrence. The appellant and Smt. Suresh were residing at house No. 924-A/60, Lekhu Nagar, Tn Nagar, Delhi. In that house parents and brothers of the appellant were also residing.
