JUDGEMENT

K.N.BASHA,CHAIRMAN - (1.) THIS appeal is preferred by the appellant challenging the order of the Deputy Registrar of Trade Marks dated 10/08/2010 making modification in respect of the earlier order passed by the Deputy Registrar of Trade Marks dated 23/06/2010 allowing the Interlocutory Petition after hearing both the parties.
(2.) MR . Arun C. Mohan, learned counsel for the appellant would submit that after passing the original order dated 23/06/2010, the appellant received the present impugned order dated 10/08/2010 modifying the earlier order dated 23/06/2010 without affording opportunity of hearing to the appellant. It is submitted that the impugned order was passed in violation of the principles of natural justice. The learned counsel would submit that notice was already served on the 1st respondent.
(3.) WE have considered the contentions of the learned counsel for the appellant and perused the original order dated 23/06/2010 and the present impugned order modifying the original order. It is seen that the 1st respondent was already served notice but neither the 1st respondent nor his representative or counsel appear before the Bench today.;
