JUDGEMENT

(1.) Pursuant to the order dated 9/08/1999, the Chief secretary,-Delhi is present in the court.
(2.) The problem in hand pertains to the pollution of the river Yamuna during its course through the territory of Delhi. From a map which has been filed in Writ Petition (Civil) No. 725 of 1994 along with an affidavit on behalf of the Haryana State Pollution Control Board (for short 'hspcb') [at page 849 of the Paper Book Vol.-V], it appears that just beyond Palla there are drain Nos. 6 and 8 coming in from Haryana which discharge their contents into the river. After the Wazirabad Water Works there are 19 drains which originate in Delhi and discharge their effluent into the river. Essentially there are two types of effluents which are Order dated 27/08/1999 in I. A. No. 7 in W. P. (C) No. 725/94responsible for polluting the river, namely, untreated sewage and untreated industrial discharge.
(3.) Till now, since the last few years, this court has been trying to see that the river does not get polluted and the quality of water improves. Orders had been passed directing the setting up of treatment plants, shutting or shifting of industries, but with no success. Perhaps it is time for the court not to determine the manner in which the pollution is to be tackled, and leave it to the State to tackle it in the appropriate manner, but hold the State accountable in case the pollution continues and the quality of water in the river Yamuna does not improve.;
