JUDGEMENT

- (1.) Learned Additional Solicitor General for the respondents-states that the respondents will not insist on the petitioners appearing for the written examination as was being done so far. Learned counsel for the respondents tenders an unconditional apology on behalf of the respondents for having insisted on the written examination which was not contemplated either under the scheme or under the order passed by this Courtly by Hon'ble Mr. Justice A.P. Sen and Hon'ble Mr. Justice Sabyasachi Mukharji on 4th February, 1987. Learned counsel for the petitioners states that it is not even necessary for the petitioners to appear before the Staff Selection Committee. We find on a perusal of the aforesaid order passed by this Court on February 4, 1987, that clause 3 of the order provides that "such artistes who shall become eligible shall be afforded an opportunity of appearing before the Staff Selection Committee". In view of this it is not possible for us to hold that in insisting upon appearing before the staff Selection Committee there is any violation of the order of this Court. In view of the unconditional apology tendered and assurance given to the Court that written examination will not be insisted upon, nothing further requires to be done in regard to the contempt petition.
(2.) Respondent shall pay to the appellant-petitioner costs of these proceedings which we quantify at Rs. 5,000/-. Appropriate compliance in the context of the earlier order of this Court shall be made within four weeks from today. Liberty to apply in case of any difficulty. Contempt Petition is disposed of accordingly. Disposed of.;
