JUDGEMENT

(1.) By our Order dated March 14, 1,986 we directed that the Writ petitioner who has complained that the establishment of the two factories near the two of Kakinada will constitute a grave source of danger to the public by causing environmental and water pollution may make a detailed representation to the Central Board for Prevention and Control of Water Pollution, New Delhi, setting out its objections in full in regard to the location and other relevant matters pertaining to the pollution said to be likely to arise as a result of the establishment of the Fertiliser factories. We directed that the Central Board should examine the said representation and to submit a detailed report to this Court within a period of three weeks from the date of receipt of such representation. In compliance with the said Order the Chairman of the Central Board for Prevention and Control of Water Pollution, New Delhi appointed an Expert Committee to visit the sites, examine all the aspects relating to air and water pollution and submit a detailed report, to him. Based on the Report of the said Expert Committee, the Chairman has submitted his report to this Court wherein he has recommended that subject to the fulfilment of the conditions mentioned in the report the industries may be allowed to be set up in Kakinada.

It is submitted before us by the counsel for the petitioner that the reports of the Chairman and the Expert Committee contain certain inherent contradictions and they cannot be therefore accepted at their face value. We are unable to find any merit in this contention. The Committee consisted of very highly qualified experts in the line and this Court finds no reason why the recommendation should not be accepted and acted upon. A further submission was made before us by counsel for the petitioner that the environmental aspect has not been examined independently by the said Committee for Experts because it is a matter to be dealt with by the State Government of Andhra Pradesh. We are assured by the learned Attorney General appearing on behalf of the State Government of Andhra Pradesh that the Government of Andhra Pradesh would take all necessary steps through the appropriate agency to ensure that the adequate safeguards are provided by the respondents, to see that there is no adverse environmental impact. This assurance in our opinion, constitutes an adequate safeguard against the possible hazards of pollution, from the environmental point of view. The authorities incharge of grant of licences will see to it that the conditions incorporated in the report of the Expert Committee constituted by the Central Board for Prevention and Control of Water Pollution, New Delhi, are fully complied with when the factories are being set up.
(3.) The Writ Petition is disposed of with these directions and, observations. The parties will bear their respective costs.;
