The challenge in the present appeal is against an order of the High Court dated 15th March, 2012 by which the grant of conditional pardon by the learned trial Court to the appellant in a proceeding under the Prevention of Corruption Act, 1988 (for short "P.C. Act, 1988") has been reversed by the High Court.
(3.) The appellant is a Chartered Accountant who was named as the accused No.2. Commission of offence under Section 12 of the P.C. Act, 1988 is alleged against the appellant. The specific case of the prosecution is that the accused No.2 had accepted the bribe demanded by the accused No.1 on behalf of the said accused. The learned trial Court took into account the facts and circumstances of the case and that the statement of the accused No.2 was recorded under Section 164 Cr.P.C. Thereafter, it allowed the request of the prosecution and granted conditional pardon keeping in view the disclosures made by the accused No.2 in the said statement.;
