JUDGEMENT

(1.) I.A. No.13 We have heard the submissions of learned Attorney
General and other learned counsel including Mr. Vikas
Singh, learned senior counsel on the issue of further
steps to be taken on the report given by the Committee
headed by Mr. M.L. Sharma, former Special Director, CBI.

Note on Administrative Issue dated 04.05.2016
We have gone through the Administrative Note given
by the CBI dated 4th May, 2016.
(2.) It is clarified that contrary to what is stated in paragraph 3 of the Note, the reports that have been
submitted by the Central Vigilance Commission have not
been approved by this Court, but have only been accepted
for taken on record and nothing more.
As far as the prayer made by the CBI is concerned,
the Director CBI will take a decision on case by case
basis whether any particular file is to be disclosed to
the Internal Vigilance of the CBI on the complaint
relating to the conduct of any specific officer.
This disposes of the Administrative Note.
Observations of the CVC dated 27.07.2015
(3.) We have gone through the observations of the Central Vigilance Commission in the Note dated 27th July, 2015.
The report of the CBI and the CVC indicates that the
enquiry into the missing files does not indicate any
criminality. Accordingly, the CVC is of the view that
the matter may be allowed to rest.;
