JUDGEMENT
B.N. Srikrishna, Lokeshwar Singh Panta, JJ. -
(1.) This an appeal filed by a Judicial Officer who was unfortunate enough to hear a petition seeking compensation and made an award under the provisions of the Motor Vehicles Act. As it turned out, the results were as disastrous for the Judicial Officer before us, as it was for the victim of the accident.
(2.) The appellant, a Judicial Officer of the rank of Civil Judge, (Senior Division), was entrusted with the jurisdiction to hear and adjudicate Motor Accident Claims cases. He heard the case of an unfortunate lady who had lost more than half of her arm in a motor accident. He took the view that the total amount of compensation payable to the victim would be Rs. 5 lacs and passed consequential orders.
(3.) This matter came up in appeal before the High Court and the High Court, disagreeing with the view taken by the appellant Judicial Officer, passed the following order :
"Heard. It is seen that the Claims Tribunal has indiscriminately awarded the compensation without applying its mind. Therefore, the Registry is directed to take note of the fact and make an entry in the confidential record."
These remarks against the appellant that he had indiscriminately awarded the compensation without applying his mind, continued even in the final judgment when the appeal was disposed off. The appellant is before us seeking expunction of these adverse remarks.;
