JUDGEMENT

(1.) Let there be no doubt that the petition for special leave deserves to be dismissed at the threshold which we hereby do. But what annoyed us is the smug albeit heartless attitude displayed in this public sector undertaking in filing this petition. National Textile Corporation was set tip with the avowed object of taking over sick textile units primarily to provide succour and relief to workmen in textile industry who would have otherwise suffered starvation and destitution. This public sector undertaking took up a untainable plea that a labour welfare officer of a nationalised textile undertaking became surplus in taking over the undertaking and could not be absorbed even though sick textile undertaking was revived with its unlimited funds it relentless pursued the welfare officer to his death. And they want to implead the heirs and legal representative of deceased labour welfare officer in this Court. Article 136 is not meant for such vengeance seeking litigation.
(2.) We dismiss this petition for special leave and direct the petitioner to pay Rs. 5000/- as costs to the respondents 2 to 6 as were they forced to file a caveat and appeared through Mr. S.N.Kacker, learned Senior Advocate of this Court instructed by learned Advocate on record.
(3.) We further direct all the payment which petitioner had to pay to the respondent pursuant to the judgment of the High Court with costs herein awarded shall be paid with interest at 18% within two months from today.;
