JUDGEMENT

- (1.)Having heard Dr. Rajiv Dhavan and Mr. V. Giri, learned senior counsel appearing for the Petitioner, Mr. P.S. Patwalia, learned Additional Solicitor General of India appearing for Respondent-Medical Council of India and Ms. Pinky Anand, learned Additional Solicitor General of India appearing for Union of India, we are convinced that the inspection which we directed to be carried out by the Medical Council of India (MCI), in our order dated 19.9.2014, cannot be effectively worked out for considering the approval to be granted to the Petitioner-institution to start its MBBS Course for the Academic Year 2014-15. We say so because though by our order dated 19.9.2014 by referring to an interim order passed on 10.9.2014 in W.P. (C) No. 688/2014, we issued our directions to the MCI and called for a Report, it is now stated that even as on date no inspection has been carried out since the last date for admission of the students, as fixed by this Court, is 30.09.2014 and it will be impossible for any authority to comply with the above directions either it be for the MCI or for the Union of India to decide as to whether recognition can be granted to the Petitioner-institution for the Academic Year 2014-15. We, therefore, direct the MCI to carry out the inspection and submit its Report to the Union of India within one month from the date of receipt of a copy of this order and thereafter the Union of India shall pass orders in accordance with law within one month after the receipt of the Report from the MCI. We make it clear that any recognition to be granted to the Petitioner institution for starting a new college for MBBS Course shall be only for the Academic Year 2015-16.
(2.)This special leave petition stands disposed of in view of the above directions to the MCI and the Union of India. All the I.As also stand disposed of. If there is any violation of the directions issued in this order, it is always open to the parties to approach this Court for appropriate orders.
