JUDGEMENT

(1.) IN spite of the last order passed by this Court on 27/7/1999 the State of Andhra Pradesh has yet not filed counter affidavit to IA No. 17. Parties seek further time to put up the upto date position in the matter and also to submit what follow up action has been taken and what will be taken in pursuance to the reports already submitted both by the Central Pollution Control Board on 8th April, 1999 and State Pollution Control Board dated 30/11/1999. This matter is pending for more than one decade. We express our anguish on the delay being caused in preparing and executing a plan to terminate the pollution. This is affecting to a large extent, both the area and population. The State is continuing to pay the compensation to the victims of this pollution which itself is a recurring loss of Revenue.
(2.) AS a last resort, we adjourn this case to be taken up on 4th April, 2000. The State Government may file their reply by 27/3/2000 to I.A. No. 17 and also submit a report as to what action has been taken so far by it in respect of the same. The District Judge's report. We are told, has not yet been given to the parties. Registry will give copy of the same to those learned counsel for the parties who so desires. The parties also by the next date give agreed issues to be decided for the purpose of disposal of this matter.
Broadly the dispute is pertaining to the compensation payable to the affected persons, which is to be considered in pursuance to the report of the District Judge. Issues of long term and short term actions to be taken to eliminate this pollution including effectively treating the polluting affluent. The various polluting industries who wish to file any affidavit to explain the treatment effectively applied may do so by filing the affidavit by 27/3/2000. We make in clear that no further time will be granted in this regard.;
