(1.) APPELLANT was the complainant before the State Commission where he had filed a complaint alleging deficiency in service on the part of the respondent Bank.
(2.) THE facts leading to filing the complaint were that the complainant who is an exporter, upon export of goods received payment in Deutch Marks sent by Commerz Bank, Germany to the respondent Bank, but it was credited with a delay of 23 days thus causing him loss on account of exchange rate difference as also loss of interest on that account. The matter was taken up with the Bank but when it was not getting settled, a complaint was filed before the State Commission, who after hearing the parties dismissed the complaint with cost of Rs. 500. Aggrieved by this order this appeal has been filed before us.
(3.) IT was argued by the Ld. Counsel for the Appellant that a Tele -printer Message was received by the Bank on 13.11.96 whereas it was credited in the account of the Appellant maintained with the respondent only on 5.12.96. He has relied upon several documents but mainly on Exhibit No. A -7 marked for the State Commission, the Tele -printer Message, which is reproduced in toto:
