JUDGEMENT

(1.) The petitioner's grievance is that he has been transferred five times within a short span of two years. The latest transfer order issued by Notification No. 1/Agri/Est.- 05/06.3110/Agri. dated 24th Dec., 2007 by the Additional Secretary to the Government has been challenged in this writ petition. The petitioner, who was holding the post of Soil Conservation Officer at Jamshepur, has been sought to be transferred and posted as the Deputy Director of Agriculture, Ranchi by the impugned order.

(2.) The ground is that the said order has been arbitrarily issued without following the prescribed rules and guidelines, even without any recommendation of the Establishment Committee.

(3.) The petitioner was appointed as District Agriculture Engineer. Sitamarhi (Bihar) on 15th Jan., 1991. After creation of the State of Jharkhand, the petitioner was allocated Jharkhand Cadre in the year 2003. On allocation of the cadre, he was posted as Soil Conservation Officer at Khunti.
