(1.) This writ petition has been heard through Video Conferencing in view of the guidelines of the High Court taking into account the situation arising due to COVID-19 pandemic. None of the parties have complained about any technical snag of audio-video and with their consent this matter has been heard.

The petitioners have preferred this writ petition for direction upon the respondents to consider the candidature of the petitioners on the post of Assistant Teacher in non para category in view of the candidates who secured less marks. Further prayer is that identical matter has already been set at rest in passed in L.P.A. No.175 of 2017, L.P.A. No.199 of 2017 and L.P.A. No.186 of 2017.
(3.) Mr. Singh, learned counsel appearing for the petitioners submits that the petitioners joined the service of Para Teacher and are working since long. All the petitioners fulfil the criteria of two years' service on the post of Para Teacher and having get the experience certificate from concerned Block Extension Officer who is the competent authority, applied for the post of Assistant Teacher in all the 13 Districts where one of the compulsory regional language is Khortha on 15.02.2006 in the Upgraded Middle School, Rakhjor, Block Sarath, District Deoghar and since then the petitioners are working as Para Teacher. The petitioners having all the requisites qualification as prescribed by NCTE, New Delhi appeared in the JTET examination conducted by Jharkhand Academic Council. Pursuant to Advertisement No.01 of 2015, the petitioners applied for the post of Assistant Teacher. Mr. Binod Singh, learned counsel appearing for the petitioners submits that the candidates who secured less marks than the petitioners, have been appointed on the post of Assistant Teachers whereas the petitioners have been deprived. He further submits that the matter has already been set at rest in view of judgment passed in aforesaid L.P.As. No.175 of 2017, L.P.A. No.199 of 2017 and L.P.A. No.186 of 2017. He submits that the respondents may kindly be directed to consider the case of the petitioners in the light of order of aforesaid L.P.As. Learned counsel also submits that the posts are still vacant.
