JUDGEMENT

(1.) No one is present on behalf of National Insurance Company Limited despite service. Shri V.P. Mathur who is present in Court, is directed to argue the matter.

This appeal under Section 173 of the Motor Vehicles Act, 1988 (for short "the Act") has been preferred by the injured Shivang Dev, appellant/ claimant herein, against the order dated 2nd March, 2006 passed by the learned Motor Accident Claims Tribunal, Kotputali, Jaipur District (for short "the Tribunal whereby claim petition of the claimant was dismissed on the basis of the decision of Issues No. 1 and 2 which were decided against the claimant on the point that the vehicle in question was not found involved in the alleged accident.
