PIRANE KHAN Vs. STATE OF RAJASTHAN

JUDGEMENT

(1.) The present bail application has been filed under Section 439 of Cr.P.C. The petitioner has been arrested in connection with FIR No. 28/2016, Police Station Mahila Thana, district Jaisalmer for the offences under Sections 363, 366, 354, 457 I.P.C. and Sections 11 and 12 of the POCSO Act.

(2.) As per the statement of the prosecutrix, the petitioner has not committed any offence against her. Even, as per the Certificate dated 06.05.2016, the date of birth of the prosecutrix is 11.05.1998.

(3.) Taking into account the facts and circumstances of the case, this Court deems it just and proper to release the petitioner on bail.
