JUDGEMENT

(1.) BY the instant criminal misc. petition under section 482 of the Code of Criminal Procedure, 1973 (for short 'the Code' hereinafter), the petitioner seeks assailing of criminal proceedings in Criminal Case No. 171/1996 pending before the Court of Judicial Magistrate, Padampur (for short 'the trial Court' hereinafter).

(2.) BRIEFLY stated the facts which are relevant and necessary for decision of the petition are that complainant-non-petitioner No. 2 Arjun (for short 'the complainant' hereinafter), who is one of the partners of partnership firm M/s. Neelkanth Marbles, filed first information report No. 94 with the Police Station, Sadar, Sri Ganganagar against the petitioner and one Vijay Kumar for the offences under sections 420 and 406 IPC. Usual Investigation was carried out by the police and negative final report was filed.

(3.) I have heard learned counsel for the parties. Carefully gone through the record of the trial Court.
