JUDGEMENT

(1.) THIS writ petition has been preferred by the petitioner against the order dated 19.2.2013 whereby the learned trial court rejected the application preferred by the petitioner under Order 14 Rule 5 read with Section 151 C.P.C.

(2.) BRIEF facts of the case are that the respondent, who happened to be mother of the petitioner, has filed a suit in the Court of Civil Judge (Junior Division), Padampur (hereinafter referred to as 'the trial court') for cancellation of gift deed dated 14.12.2007 alleged to have been executed by her in favour of the petitioner.

(3.) LEARNED counsel for the petitioner has argued that the learned trial court has failed to frame proper and additional issues as per the pleadings of the parties and the application of the petitioner for framing of proper and additional issues moved under Order 14 Rule 5 read with Section 151 C.P.C. has been dismissed by the trial court in cursory manner and, therefore, the order dated 19.2.2013, rejecting the aforesaid application of the petitioner is illegal and is liable to be set aside. This Court has taken into consideration the impugned order dated 19.2.2013 passed by the learned trial court.
