JUDGEMENT

(1.) HEARD learned counsel for the parties.

(2.) BY the impugned order dated 18.05.2010, the learned Civil Judge (Jr. Division), Marwar Junction, District: Pali, has allowed the application filed by the respondent No.4, Nasir Hussain, under Order 1 Rule 10 CPC, who had purchased the suit property from the owners (plaintiffs/respondents No.1 and 2 herein) under a registered release-deed dated 23.10.2009.

(3.) HAVING heard the learned counsel for the petitioner- defendant and respondent/applicant, this Court does not find any force in the present writ petition since the issue of title is of no relevance in the eviction matters; and as far as the grounds of eviction are concerned, both the parties are at liberty to establish their respective case or defense by leading evidence.
